1. Introduction

These Terms and Conditions (“Terms”) govern your use of the services provided by Jessamy Staffing Solutions Limited (“Jessamy”, “we”, “us”, “our”), including:
● Recruitment and staffing services for temporary, permanent, and contract workers.
● Homecare, supported living, and short break services delivered by our group.
● Training and CPD-accredited learning programmes.
● Use of our websites: www.jessamystaffing.co.uk and www.jessamyhomecare.co.uk.
By engaging with our services, you agree to comply with these Terms. Please read carefully.

2. Definitions

Client – any organisation or individual contracting with Jessamy for staffing, training, or care services.
Candidate / Worker – any person applying for, or engaged in, work through Jessamy.
Service User – an individual receiving homecare or supported living services.
Agreement – any signed contract, framework agreement, or service specification with Jessamy.
CPD Course – any training programme provided by Jessamy accredited by the CPD Standards Office.

3. Services Provided

1. Recruitment & Staffing: Supplying temporary, permanent, and contract staff in healthcare, social care, and related sectors.
2. Homecare & Supported Living: Regulated by the Care Quality Commission (CQC), delivering domiciliary, respite, and transitional care services.
3. Training & Development: CPD-accredited courses and professional qualifications for clients, employees, and third parties.

4. Client Obligations

Clients engaging Jessamy services agree to:

Provide accurate information about staffing needs, shifts, and placements.
Ensure safe working conditions for staff placed at their sites.
Comply with all applicable laws, including health and safety legislation.
Pay invoices in accordance with agreed terms (see Section 8).
Not approach or employ Jessamy workers directly during or for 6 months after termination of assignment unless agreed with us in writing (transfer fee may apply).

5. Candidate & Worker Obligations

Candidates/workers engaged through Jessamy agree to:

Provide accurate personal, professional, and compliance information (e.g., DBS, right to work).
Maintain required training, insurance (where applicable), and professional conduct.
Adhere to confidentiality, safeguarding, and data protection standards.
Comply with Jessamy’s policies (including No Contact Policy, Equal Treatment, Substance Misuse).

6. Training Participants

When enrolling in Jessamy CPD courses, participants agree to:

Provide accurate enrollment information.
Abide by course codes of conduct (see Disruptive Learner Policy).
Accept that CPD certificates are issued only upon successful completion of course requirements.
Not reproduce course materials without written permission.

7. Safeguarding & Compliance

Jessamy operates within the highest safeguarding standards. We are committed to:

Reporting safeguarding concerns to relevant authorities.
Ensuring all staff are trained in child and adult safeguarding.
Compliance with CQC, Ofsted, UK GDPR, and the Data Protection Act 2018.
Maintaining governance and audit trails for commissioners and regulators.
Clients, candidates, and service users must co-operate with any safeguarding investigations.

8. Fees, Payment & Invoicing

Jessamy operates within the highest safeguarding standards. We are committed to:

Staffing services are charged at agreed hourly/daily/contracted rates.
Homecare/support services are billed as per local authority frameworks or private care contracts.
Training courses must be paid in advance unless otherwise agreed.
All invoices are due 14 days from the date of invoice unless agreed otherwise.
Late payments may attract statutory interest under the Late Payment of Commercial Debts (Interest) Act 1998.

9. Cancellation & Termination

Jessamy operates within the highest safeguarding standards. We are committed to:

Staffing bookings: Cancellations less than 24 hours before shift start may incur full charge.
Training courses: Cancellations less than 7 days prior to course date are non-refundable.
Care services: Termination requires 14 days’ written notice unless otherwise required by safeguarding or contractual obligations.
Jessamy reserves the right to terminate any agreement immediately if there is non-payment, misconduct, safeguarding risk, or breach of law.

10. Liability & Insurance

Jessamy maintains appropriate public liability, professional indemnity, and employer’s liability insurance.
We are not liable for indirect or consequential losses, loss of profit, or reputational damages.
Our total liability shall not exceed the total fees paid under the specific contract giving rise to the claim.

12. Intellectual Property

All training materials, branding, logos, documents, and digital resources remain the intellectual property of Jessamy Staffing Solutions Limited. Clients and participants may not reproduce, distribute, or adapt materials without prior written consent.

13. Force Majeure

Jessamy shall not be liable for failure or delay in providing services due to events beyond our reasonable control (e.g., strikes, pandemics, natural disasters, IT failures).

14. Complaints & Dispute Resolution

Jessamy shall not be liable for failure or delay in providing services due to events beyond our reasonable control (e.g., strikes, pandemics, natural disasters, IT failures).

15. Governing Law

These Terms are governed by and construed in accordance with the laws of England & Wales.

16. Variation

Jessamy reserves the right to amend these Terms from time to time. Updated
versions will be published on our website and made available to clients, workers,
and service users.
